On Monday 23rd February 2026, the government released their white paper “Every Child Achieving and Thriving.” This a document that sets out a long‐term vision and framework for reforming the education system in England so that every child and young person is supported to reach their full potential.
It outlines wide-ranging plans to improve schooling overall, alongside generational reforms to the special educational needs and disabilities (SEND) system.
First and foremost, it is very important to understand that a “White Paper” is not a change in law, it is a document that sets out the government’s ideas and proposal for change.
There will be a 12 week consultation period where anyone can send their feedback on the white paper. This includes parents and carers, schools, professionals, parent carer forums, charities – anyone who is invested in supporting children and young people with SEND.
Following the consultation period, the government will review the feedback and may revise their proposals.
After this, where changes to law may be required, the government must introduce a Bill to parliament. The Bill is debated and examined by members of parliament and the House of Lords, ammendments can still be made at this stage.
Only once both Houses agree, does the Bill receive Royal Assent and become an Act of Parliament.
There are some elements of the White Paper that can be introduces through policy change, or updating guidance, however anything that ius currently embedded in Law, like EHC process, rights to appeal etc, can only change when law changes.
